AGREEMENT TO OUR LEGAL TERMS

We are Loamian ("Company," "we," "us," "our"). We operate the website loamian.com and the Loamian platform (the "Services"). You can contact us at hello@loamian.com or by mail at 1017 Rumley Road, Forney, TX 75126, United States.

By using our Services, you agree to these legal terms. If you do not agree, stop using the Services immediately.

1. OUR SERVICES

Loamian is an AI-powered business management platform providing small business owners with automated tools including client onboarding, proposal writing, inbox management, follow-up sequences, and weekly business briefings. Services are for personal and internal business use only. We are hosted in the United States.

2. INTELLECTUAL PROPERTY

We own all intellectual property rights in our Services. You may not copy, reproduce, distribute, or create derivative works from any part of our Services without written permission. If you believe your copyright has been infringed, contact us at hello@loamian.com with a description of the work, the infringing material, your contact information, and a statement of good faith belief.

3. USER ACCOUNTS

You may register for an account and connect it to Google. You are responsible for maintaining the confidentiality of your credentials. You must be at least 18 years old to use our Services.

4. SUBSCRIPTIONS AND PAYMENTS

Loamian offers a monthly subscription that automatically renews. We accept Visa, Mastercard, American Express, and Discover. All payments are in US dollars processed through Stripe. Founding Member rate: $67/month, locked for life for the first 20 customers. Standard rate: $97/month. We do not offer refunds. You may cancel your subscription by contacting us at hello@loamian.com. Cancellation takes effect at the end of your current billing period.

5. PROHIBITED ACTIVITIES

You may not use our Services to violate any law, transmit harmful content, attempt to gain unauthorized access, or interfere with the Services. You may not reverse engineer any part of the platform.

6. THIRD-PARTY LINKS

Our Services may link to third-party websites. We are not responsible for the content or practices of those sites.

7. DISCLAIMER OF WARRANTIES

THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE SERVICE.

8. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR LIABILITY IS LIMITED TO THE AMOUNT YOU PAID US IN THE LAST 12 MONTHS. THIS LIMITATION APPLIES FOR ONE YEAR FROM THE DATE YOUR CLAIM ARISES.

9. DISPUTE RESOLUTION

Before filing any claim, you agree to attempt informal negotiations for 30 days by emailing hello@loamian.com. If unresolved, disputes will be resolved by binding arbitration in Kaufman County, Texas. Litigation, if any, will take place in Texas. These terms are governed by the laws of Texas, United States.

10. PRIVACY POLICY

Your use of our Services is subject to our Privacy Policy at https://loamian.com/privacy.

11. UPDATES TO THESE TERMS

We may update these terms and will notify you by email. Continued use after notification constitutes acceptance.
